7. Working hours and rest
Working hours are [number] hours a day and [number] hours a week, within the limits of the Labour Law of 8 hours a day and 48 hours a week. In Ramadan, working hours for Muslim employees are no more than 6 hours a day and 36 hours a week. The Employee will have rest, prayer and meal breaks of at least 30 minutes so that no more than 5 consecutive hours are worked without a break. The weekly rest day is [day], with full pay. Overtime is paid at the hourly wage plus 50% of the basic hourly wage, or compensated with paid time off where the Employee agrees, as the Labour Law provides.

8. Annual leave
The Employee is entitled to paid annual leave of [21 or more] days a year, rising to [30 or more] days after five consecutive years of service with the Employer, paid in advance. The Employer sets the leave dates according to the needs of the work and notifies the Employee at least 30 days in advance. Other leave (sick, Hajj, marriage, bereavement, birth, maternity and exam leave) is granted as the Labour Law provides.

9. Medical insurance and social insurance
The Employer will provide medical insurance for the Employee [and eligible family members] under the cooperative health insurance rules, and will register the Employee with the General Organization for Social Insurance.

10. Notice and ending the contract
[For an open-ended contract:] Either party may end this contract for a valid reason by giving the other written notice of at least [30] days when the Employee ends it and at least [60] days when the Employer ends it. A party that does not observe the notice period shall pay the other party compensation equal to the Employee’s wage for the notice period. [For a fixed-term contract:] The contract ends when its term ends unless renewed.

11. End-of-service award
When this contract ends, the Employee is entitled to an end-of-service award calculated on the last wage, under Articles 84 to 88 of the Labour Law, according to the length of service and the reason the contract ended.

12. Confidentiality
The Employee will not disclose the Employer’s trade secrets, client information or other confidential information during employment or after it ends, and will return all documents, devices and property of the Employer when the contract ends.

13. Work regulations
The Employee has read the Employer’s work regulations and agrees to comply with them. Any penalty is applied only as those regulations and the Labour Law provide.

14. Governing law and disputes
This contract is governed by the Saudi Labour Law, its Implementing Regulations and the decisions issued under it. Anything not covered here follows the Labour Law. Disputes go first to amicable settlement through the Ministry of Human Resources and Social Development and then to the labour courts.

15. Language and copies
This contract is made in Arabic and English in two copies, one for each party. If the two texts differ, the Arabic text prevails.

First party (Employer)
Name: [Name of the authorised signatory]
Title: [Job title]
Signature and stamp: [Signature and company stamp]

Second party (Employee)
Name: [Employee full name]
Signature: [Signature]

When to use it

Use this template for every new hire, Saudi or non-Saudi, before the start date. The contract must be in writing in two copies and documented on Qiwa (Article 51 as amended in 2025), and it follows the ministry’s unified model (Article 52). You can add your own clauses as long as they do not give the employee less than the law.

How to fill it in

  1. Choose the contract type. An open-ended contract ends by notice under Article 75; a fixed-term contract ends when its term ends. For a non-Saudi employee, check the contract types Qiwa offers for that worker before choosing.
  2. Write the probation in days. Up to 180 days in total (Article 53). A second probation with the same employer needs written agreement and a different job, or at least six months since the earlier employment ended (Article 54).
  3. Split the wage. List the basic wage and each allowance separately. GOSI contributions are calculated on basic plus housing, and the end-of-service award on the actual wage, so the split matters.
  4. Keep the hours within the law. 8 hours a day and 48 a week, and 6 hours a day and 36 a week in Ramadan for Muslim employees (Article 98).
  5. Match Qiwa exactly. The wage you enter in Qiwa must be the one in the contract, because the Mudad wage file and the GOSI wage are checked against it.
  • Notice (Article 75 as amended): for monthly-paid employees on open-ended contracts, at least 30 days when the employee ends it and 60 days when the employer does; for other employees, 30 days either way. Failing to give notice costs the wage for the notice period (Article 76).
  • Annual leave (Article 109): at least 21 days, and 30 after five consecutive years. Leave cannot be waived or paid out in cash during employment.
  • Overtime (Article 107): the hourly wage plus 50% of the basic hourly wage, or paid time off with the employee’s consent.
  • Arabic prevails (Article 9) over any other language version.

A worked example: a basic wage of 6,000 SAR with a housing allowance of 1,500 SAR and transport of 500 SAR gives a total wage of 8,000 SAR and a GOSI contributory wage of 7,500 SAR.

In RafiqHR, contract and probation data sit on the employee record with effective-dated history, and probation check-ins are part of the onboarding plan.

Frequently asked questions

Does an employment contract have to be documented on Qiwa?

Since the 2025 amendments, Article 51 requires the contract to be written in two copies and documented under the applicable rules. In practice, private-sector contracts are documented on Qiwa, and the wage in the Mudad file and with GOSI must match the documented contract.

How long can probation be?

Up to 180 days in total, and it must be stated in the contract (Article 53 as amended). The Implementing Regulations set which leave days do not count towards it, and either side may end the contract during probation without an end-of-service award or compensation.

If the Arabic and English versions differ, which one applies?

The Arabic text. Article 9 makes Arabic the language of contracts and provides that it prevails when the employer also uses another language.

Can the contract give the employee more than the law?

Yes. Any term that is more favourable to the worker is valid. A term that gives less than the Labour Law is void (Article 8), and the legal minimum applies instead.
