The rule used here

Article 51: monthly-paid workers get 15 days for each of the first five years and a month for each year after, capped at one and a half years’ wage. Daily, hourly and piece-rate workers get 10 days, then 15 days, capped at one year’s wage. Part-years count pro rata, and social insurance contributions may not be deducted (Law 85 of 2017). Article 53 on resignation: nothing under three years, half to under five, two thirds to under ten, the full award from ten. Dismissal under Article 41(a) is without indemnity.

What the calculator assumes

  • Daily wage = monthly wage ÷ 30. Article 51 does not say basic or total wage, and the law defines wage broadly.
